Terms of service

1. Acceptance

By downloading Pepito Curioso, creating an account or using the app, you accept these terms. If you disagree with any of them, the consistent thing to do is not to use the service.

If you are a minor, your parent or guardian needs to read and accept these terms with you.

2. What Pepito Curioso is

Pepito Curioso is a learning app built on the protégé effect: you learn by explaining. You pick a topic, explain it to Pepito by voice or in writing, and he asks questions until he understands. His questions point at the gaps in your explanation.

The app has a free tier with daily limits and an optional subscription that removes them. We may add, change or retire features as the product evolves.

3. Who can use it

You can use Pepito Curioso if you are old enough, under the law of your country, to enter into this kind of agreement on your own. Below that age, the consent of your parent or guardian is required.

Whoever accepts on behalf of a minor is responsible for how that minor uses the app and for purchases made from their account.

4. Your account

• The information you give us when signing up has to be true, though the nickname can be made up.
• Your account is yours: do not share it or hand it over.
• Tell us if you think someone else has got into it.
• You can close it whenever you like, from the app.

5. What you explain is yours

Your explanations, spoken or written, remain yours. We claim no ownership over them.

To provide the service we need a limited permission: to process them, transcribe them, show them back to you in your history, and generate Pepito’s questions and your progress from them. That permission is free of charge, non-exclusive and lasts as long as your account; when you delete a session, it stops applying to it.

We do not use your explanations to train AI models and we do not publish them anywhere.

6. Pepito gets things wrong

Pepito is a character generated by artificial intelligence. He asks good questions, but he can state incorrect things, mark a correct explanation badly, or accept a wrong one.

The app is for practising explaining; it is not a source of truth and does not replace your teachers, your notes or a textbook. Do not use it as academic, medical, legal, financial or any other kind of professional advice, and always check anything that matters.

The mastery score for a topic is a game signal, not a certification of anything.

7. Acceptable use

By using the app you agree not to:

• Upload illegal, violent, sexual or hateful content, or content that harasses someone.
• Impersonate another person or give false details to create an account.
• Try to extract, copy or reuse the system behind Pepito, or reverse-engineer the app.
• Automate use of the service with bots or scripts, or work around the energy and ad limits by technical means.
• Interfere with the service, overload it, or try to access other people’s accounts.
• Use the app to harm a child or to contact children outside what the app allows, which is nothing.

If you break these rules we may limit or close your account.

8. Brains, energy and streak

The app has three counters. Brains are earned by explaining well and spent on hints, gap detectors and student skins. Energy caps how many sessions you get per day and recharges on its own over time. The streak counts consecutive days of teaching.

• They are virtual in-game items: not money, not cryptocurrency, and not an asset with any value outside the app.
• They cannot be redeemed for cash, sold, transferred to another account or taken out of the app.
• They are non-refundable, including if you close your account or if we stop providing the service.
• We may adjust how they are earned and what things cost in order to balance the game.

9. Tutor Pro

Tutor Pro costs USD 4.99 per month, removes the energy limits and removes ads. The price may vary by country and applicable taxes.

• It is bought and billed through the App Store or Google Play, with the account you hold at that store.
• It renews automatically each period until you cancel it.
• Cancellation is done in the store’s subscription settings, not inside the app, and takes effect at the end of the period already paid for.
• Refunds are handled by the store, under its own terms.
• If we change the price, we will tell you before it applies to a renewal.

10. Advertising

On the free tier you can choose to watch a thirty-second ad to get a unit of energy back. It is always voluntary: a session is never interrupted by advertising, and not watching ads does not block learning, only the pace.

11. Intellectual property

The app, the Pepito character, the name, the logo, the design, the copy and the software are ours or licensed to us. We grant you a personal, revocable, non-transferable licence to use the app as intended; nothing more.

12. Service availability

We aim to keep the app available at all times, but there can be outages for maintenance, failures or causes outside our control. We may change features, introduce limits or stop providing the service; if it were going to shut down, we would give reasonable notice inside the app.

13. Ending the agreement

You can stop using the app and close your account whenever you like. We may suspend or close an account if these terms are broken, if there is a security risk, or if a rule requires it.

When an account closes, the progress and virtual items attached to it are lost, and an active subscription is cancelled according to the store’s rules.

14. No warranties

The app is provided as is and as available. To the extent the law allows, we do not guarantee that it will run without errors or interruptions, that what Pepito says is accurate, or that using it will improve your academic results.

This does not affect any consumer rights the law gives you that cannot be excluded by contract.

15. Limitation of liability

To the extent the law allows, we are not liable for indirect damages, loss of data, lost profits or the consequences of having relied on something Pepito said. Our total liability is limited to what you have paid for the service in the previous twelve months.

None of this excludes liability for wilful misconduct, gross negligence, or damages the law does not allow to be excluded.

16. Governing law

These terms are governed by the law of the country where the company is domiciled, and any dispute is submitted to its courts. If you are a consumer, you keep the right to bring a claim before the courts where you live and the protection your own country’s law gives you.

17. Changes to these terms

We may update these terms. When a change matters, we will say so inside the app before it takes effect. Continuing to use the service after that date means you accept the new version; if you do not accept it, you can close your account.
